Privacy policy

The purpose of this Privacy Policy (hereinafter, the "Policy") is to regulate the processing of personal data carried out by Club Deportivo Leganés, S.A.D. (hereinafter, "Club") and LaLiga Group International, S.L. (hereinafter, "LaLiga"), through the platform. Therefore, the personal data you provide to access and, where appropriate, register on the platform will be processed by both entities as co-responsible for the processing.

To enjoy the advantages of the platform, you must register in LaLiga Ecosystem, through which you access an environment created by LaLiga, made up of several applications and websites, both from LaLiga and the affiliated football clubs with which LaLiga has collaboration agreements, where, through a common register implemented by LaLiga in these assets (LaLiga Single Sign-On), each user receives a unique identifier so that any selection or modification of preferences or request for deletion made in one of the applications or websites that are part of the ecosystem will affect the rest of the LaLiga Ecosystem environment and the entities that comprise it.

Who is responsible for the processing of your personal data?

On the one hand, your personal data will be processed by LaLiga, with CIF B-05421805 and address at Calle Torrelaguna 60, 28043, Madrid.

On the other hand, your personal data will be processed by Club Deportivo Leganés, S.A.D., with CIF A28526010 and address at C/Arquitecto, S/N, CP 28918, Leganés (Madrid), a sports limited company.

Users of the platform may contact LaLiga's and/or the Club's Data Protection Delegate to find out the essential content of the co-responsibility agreement between both parties in relation to the platform.

If you feel that your rights have been disregarded, you may lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).

In the event that you access the YouTube videos embedded in the Platform, LaLiga informs you that the data controller for the purpose of providing you the content viewing services will be Google Ireland Limited, with registered office at Gordon House, Barrow. Street, Dublin 4, Ireland.

Where do we get your personal data from?

The Club and LaLiga will process the personal data you provide through the registration form (email and preferred language, requested as mandatory data and name, surname, date of birth, gender, country, province, city, address, postal code and telephone number as optional data) and other data inferred as a result of your use and activity on the platform (registered user ID, device ID, operating system, device model and telemetry, for example, will also be recorded when you click on a certain content or for a certain amount of time spent on the asset) or your interactions with communications with the Club and LaLiga; device ID; operating system; device model and telemetry, for example, will also be recorded when you click on certain content or how long you stay on the asset) or your interactions with communications we send you via email, if applicable (for example, clicking on the content of a communication).

Likewise, in the event that you are a user of another asset that is the responsibility of LaLiga or in which LaLiga acts as co-responsible for the data and which forms part of the LaLiga Ecosystem, the Club may receive the aforementioned personal data, declared or inferred in said assets.

Importing data from social networks

We inform you that you can use the social networks of which you are a user to register or access LaLiga Ecosystem, as well as to share with LaLiga and the Club additional information about your profile on these social networks.

Data shared through Facebook:

· Name and profile picture (Required for registration. However, we inform you that neither LaLiga nor the club will treat your profile picture).

· E-mail address (Required).

· Birthday (Optional).

· Gender (Optional).

· Current city and province (Optional).

· Like the page (Optional).

· Posts in biography (Optional. Your public and private biography posts, including photos and videos, information about the places tagged in them and the types of reactions they receive).

Thanks to the likes on the page and the posts in the biography, LaLiga will obtain the following inferred data:

· Engagement" value: this value measures the volume of interactions that the user has with the Facebook wall of LaLiga's official page.

· Social" value: this value measures the user's social media influence.

· Promotion" value: users' walls are analysed for references to sweepstakes, promotions and sweepstakes entries, and a value is assigned that measures the promotional ratio on the user's wall. It also checks whether the user's profile follows Facebook pages dedicated to advertising promotions, raffles, and sweepstakes.

· Fan Value: This score is a combination of the previous 3 scores that ranks users by the value obtained (a user with a higher score will be considered a more valuable user).

Data shared through Google:

· Name and surname (Required for registration).

· Email address (Required for registration).

Neither LaLiga nor the Club are responsible for the legal suitability of the social network that you use for the aforementioned purposes. For this reason, we recommend that you review the terms of use and privacy policy of the social networks that you are going to use for these purposes so that you can verify that the processing of your personal data is in accordance with your expectations of privacy and the data protection regulations applicable in each case.

Once the data has been imported and incorporated into your registered user account, your data will be integrated into LaLiga Ecosystem and processed by LaLiga and the Club for the purposes described in this Privacy Policy.

For what purposes do we process your personal data?

Main purposes:

- On behalf of the Club and LaLiga:

Both LaLiga and the Club undertake to process your personal data in accordance with the provisions of the applicable regulations and, in particular, for the following purposes:

/ Registration and access to the platform: We inform you that the personal data you provide when registering on the platform will be processed by the Club and LaLiga for the purpose of facilitating your registration and access to the platform. Likewise, LaLiga will use them to allow you access to the rest of the LaLiga Ecosystem assets. In particular, the Club and LaLiga will use the following personal data to fulfil this purpose:

- Email: mandatory and necessary to register on the platform.

- Language of the platform (mandatory).

- Name and surname (optional).

- Date of birth (optional).

- Sex (optional).

- Country (optional).

- Province (optional).

- City (optional).

- Address and postcode (optional).

- Telephone (optional)

In this regard, we inform you that in order to verify the validity of the email address provided to the Club and LaLiga to register on the platform, LaLiga and the Club use the services of a third party provider (RP Solutions, Inc.) which involves the international transfer to the United States, in this case of the email address provided. This country does not guarantee an equivalent level of protection to that of the European Economic Area. For this reason, the Club and LaLiga have signed standard contractual clauses adopted by the European Commission with these service providers by virtue of the provisions of art. 46.2 c) of the General Data Protection Regulation, including additional guarantees and obligations addressed to these providers for the greatest possible security and transparency. The content of the standard contractual clauses is available on request at lopd@laliga.es and lopd@cdleganes.com.

The legal basis for the aforementioned purpose is that the processing is necessary for the execution of the requested services regulated through the legal terms of the platform under the provisions of art. 6.1 b) of the General Data Protection Regulation. In this regard, we inform you that the data identified as mandatory are necessary to manage your registration and access to the APP as well as to send you in-app and push notifications related to the same. If you do not provide them, we will not be able to carry out the aforementioned purposes.

/ On the part of LaLiga:

Internal reporting: Likewise, LaLiga will process in aggregate form the personal data you have provided through registration (in this case, country) or social login (where applicable, birthday, gender, page likes and current city), as well as Platform usage data (user ID, device ID, device model, operating system and telemetry, e.g., clicking on a particular content or time spent on the asset) and interactions with the communications you receive (e.g. clicking on the content of a communication) for the development of relevant metrics and statistics that allow LaLiga to analyse the impact of its campaigns, as well as the interest that the campaigns have aroused among stakeholders based on the data analysed. In particular, LaLiga will carry out aggregate segmentations based on the aforementioned data, among which are:

o Segmenting according to country. (e.g. 20 users from Spain have participated in the Sweepstakes).

The legal basis for the aforementioned purpose is that the processing is necessary to satisfy the legitimate interest of LaLiga by virtue of the provisions of art. 6.1 f) of the General Data Protection Regulation, consisting of extracting lessons learned from the information provided and obtained from users to enable it to improve the Platform and optimise the communication campaigns it carries out based on the interest that these generate among the different groups of users. Before doing so, we inform you that LaLiga has carried out an analysis of proportionality between its legitimate interest and the rights and freedoms of its users. You can request the conclusions of this analysis at lopd@laliga.es.

You have the right to object to the above-mentioned purpose at any time in accordance with the procedure described in the section "What are your rights when you provide us with your personal data?" .

Additional purposes

The additional purposes for which the Club and LaLiga will process your personal data are set out below:

(i) On behalf of the Club:

Commercial communications from the Club: So that the Club can send you commercial communications via email or SMS, whatsapp or other instant messaging channels about its activities (campaigns, shows or live events), products (applications, web platforms and games), competitions, offers, prize draws and/or promotions of the Club, or competitions, offers, prize draws and/or promotions carried out by the Club in collaboration with its official sponsors.

For this purpose, the Club will only process the e-mail address and, where applicable, the telephone number that you have provided on the registration form.

We also inform you that, in order to send you commercial communications via email or SMS, the Club uses a service provided by a third party provider (salesforce.com EMEA Limited) which involves the international transfer of the email and/or telephone address you have provided us with to the United States, a country where an equivalent level of protection to that of the European Economic Area is not guaranteed. For this reason, the Club has signed standard contractual clauses adopted by the European Commission with these suppliers by virtue of the provisions of art. 46.2 c) of the General Data Protection Regulation, including additional guarantees and obligations addressed to these suppliers for greater security and transparency. The legal basis for processing your data for the above-mentioned purpose is the consent you have given us to process your data for the specific purposes selected in accordance with the provisions of art. 6.1 a) of the General Data Protection Regulation. Your personal data will be kept for this purpose until you revoke your consent.

You have the right to withdraw your consent at any time in accordance with the procedure described in the section "What are your rights when you provide us with your personal data? "without affecting the lawfulness of the consent-based processing prior to its withdrawal.

Simple profiling: So that the Club can send you segmented commercial communications via email, SMS, whatsapp or other instant messaging channels, about the content mentioned in the purpose "Club commercial communications" (for example, we will send you commercial communications about products that may interest you based on the age or province of residence that you have provided in your profile).

The aforementioned information will be targeted at simple segments (groupings of users based on the information provided by them in their profile) that the Club can elaborate taking into account the following:

- Low level of profile detail. The Club could create simple segments, e.g. segments on women over 25 years old.

- Non-exhaustive profile. In order to carry out the segments, the Club will only process the personal data that you have provided on this platform or in any of the LaLiga Ecosystem assets. In particular, the Club will use the following personal data:

o Country of residence.

o Region or province.

o Age.

o Gender.

o City of residence.

o Language.

o Postcode.

- Positive consequences for the user. The Club will be able to send you commercial communications that best fit the profile you have declared, avoiding unwanted commercial communications or uninteresting content.

The legal basis for the aforementioned purpose is the Club's legitimate interest in making effective use of the personal data provided by the user in order to achieve greater interest and return of the communications sent. Before doing so, we inform you that the Club has carried out an analysis of the proportionality between its legitimate interest and the rights and freedoms of its users, the conclusions of which can be requested at lopd@cdleganes.com.

You have the right to object to the above-mentioned purpose at any time in accordance with the procedure described in the section "What are your rights when you provide us with your personal data".

/ Comprehensive profiling:

- Personalised experiences and information: So that the Club can send you personalised commercial communications via email, SMS, whatsapp or other instant messaging channels about the content mentioned in the purpose "Club commercial communications" (for example, we will send you commercial communications about products that may interest you based on the interactions you have had with other communications and your activity on the platform).

The aforementioned information will be directed to the exhaustive segments (groupings of users that are made based on the information obtained from them or inferred from their use of the platform or other assets of LaLiga Ecosystem) that we can elaborate based on:

· The information you provide during registration (in this case, date of birth, gender, country, province and city);

· Social login (in this case, gender, city you live in, biography posts - information about the places tagged in them and the types of reactions they receive, page likes);

· Interactions with communications or notifications you receive (e.g. clicking on the content of a communication);

· Data inferred as a result of usage and activity on the platform (device ID, registered user ID, device model, operating system and telemetry, e.g., clicking on particular content or time spent on the asset); and

· The personal data you have provided in other assets under the responsibility of LaLiga and any inferred data obtained in other assets under the responsibility of LaLiga as a result of your use and activity in those assets.

In addition, the Club will generate these segments taking into account the following profiling techniques:

· Campaign optimisation: we will exclude you from advertising campaigns about sweepstakes you have entered, apps you have registered for or downloaded, products you have purchased or services you have previously purchased (for example, we will avoid offering you a Club app if we know you have previously downloaded it).

· Users similar to your tastes and preferences: thanks to the Club's profiling of you, we can send you personalised content taking into account other profiles similar to yours (for example, if we identify that other users similar to you like eSports, we will show you advertising related to eSports).

The legal basis for processing your data for the above-mentioned purposes is the consent you have given us to process your data for the selected purposes. Your personal data will be kept for these purposes until you revoke your consent.

You have the right to withdraw your consent at any time in accordance with the procedure described in the section "What are your rights when you provide us with your personal data?" without affecting the lawfulness of the consent-based processing prior to its withdrawal.

(ii) On the part of LaLiga:

/ LaLiga commercial communications: So that LaLiga can send you commercial communications via email or SMS or other instant messaging channels about its activities (the competitions it organises, campaigns, public viewings, shows or live events), products (applications, web platforms and games developed by LaLiga), services, competitions, offers, draws and/or promotions of LaLiga itself, or competitions, offers, draws and/or promotions carried out by LaLiga about products and services promoted jointly by LaLiga with its official sponsors, which you can consult here www.laliga.es/sponsors (hereinafter, the "Official Sponsors"), national federations or national and international television channels (hereinafter, "LaLiga products and services"). For this purpose, LaLiga will only process the e-mail address.

We also inform you that, in order to send you commercial communications via email or SMS, LaLiga uses a service provided by a third party provider (salesforce.com EMEA Limited) which involves the international transfer of the email address you have provided us with to the United States, a country where an equivalent level of protection to that of the European Economic Area is not guaranteed. The legal basis for the aforementioned purpose is that the processing is necessary for the satisfaction of the legitimate interest of LaLiga by virtue of the provisions of art. 6.1 f) of the General Data Protection Regulation, consisting of making effective use of the personal data provided by the user in order to achieve greater interest and return of the communications sent. Before doing so, we inform you that LaLiga has carried out an analysis of proportionality between its legitimate interest and the rights and freedoms of its users, the conclusions of which you can request at lopd@laliga.es.

Elaboration of exhaustive profiles: LaLiga will create an exhaustive profile of you so that it can offer you personalised advertising, information, services and products through the sending of personalised commercial communications via email, SMS, or other instant messaging channels, sending you personalised push or in-app notifications (provided that you have given your consent for the purpose "LaLiga commercial communications") or showing you banners with personalised advertising on websites, apps or social networks about LaLiga products and services (for example, if we identify that you are a fan of a specific club, we will offer you personalised incentives, such as a jersey of your favourite team).

In this way, the aforementioned information will be directed to the segments (groupings of users that are made according to the information obtained from them or the use they make of the platform or other assets of LaLiga Ecosystem) that we can elaborate based on the following data sources:

· The information you provide during registration (in this case, country of residence);

· The social login (in this case, first and last name, email address, birthday, gender, city and province in which you reside, interest categories, as well as those inferred values - engagement, social, promotion and fan value - obtained from the posts in your Facebook biography and the likes on the page);

· Interactions with communications or notifications you receive (e.g. clicking on the content of a communication);

· Data inferred as a result of use and activity on the Platform (registered user ID, device model, operating system and telemetry, e.g. clicking on particular content or time spent on the asset or surveys you take about LaLiga or the competition).

In addition, LaLiga will generate these segments taking into account the following profiling techniques:

· Measurement of individual campaign performance: LaLiga will use information relating to open rates, average click-through rates, email bounce rates or unsubscribe rates to measure campaign performance at an individual level and, as a consequence, perform segmentations based on the information inferred about you and the other information declared (for example, if you are a very active user in certain communications, we may send you communications of the same type more frequently).

· Campaign optimisation: we will exclude you from advertising campaigns about sweepstakes you have entered, apps you have registered for or downloaded, products you have purchased or services you have previously purchased (for example, we will avoid offering you a LaLiga app if we know you have previously downloaded it).

· Users similar to your tastes and preferences: thanks to LaLiga's profiling of you, we can send you personalised content taking into account other profiles similar to yours (for example, if we identify that other users similar to you like eSports, we will show you advertising related to eSports).

· User rating: LaLiga will obtain an unknown variable from known variables provided or inferred from you so that it can carry out an analysis of its users with the aim of identifying those with a greater propensity to use or contract LaLiga products, and where appropriate, offer you LaLiga products and services.

How long will we keep your personal data?

The personal data we process will be kept for as long as the purposes for which they were collected persist and/or you do not revoke any consent you may have given, or you do not exercise your rights of erasure, objection or restriction of processing.

In this regard, the Club and LaLiga will keep your personal data duly blocked for the following retention period for the sole purpose of attending to any liabilities of any kind that may arise:

· Registration and access to the platform: the data provided for registration and access to the platform will be kept as long as you do not request the deletion of your data, this purpose persists and, once this purpose has ended, during the period of limitation of the legal actions that may arise from it.

· Internal reports: the data provided for internal reports will be kept as long as you do not request the deletion of your data, this purpose persists, you do not object to the processing and, once this purpose has been fulfilled, during the period of limitation of the legal actions that may derive from it.

· Commercial communications from the Club: the data provided for commercial communications carried out by the Club will be kept as long as you do not request the deletion of your data, this purpose persists, you do not revoke the consent granted or limit the processing and, once this purpose has been fulfilled, during the period of limitation of the legal actions that may derive from the same.

· Preparation of simple profiles by the Club: the data provided for the preparation of simple profiles will be kept as long as you do not request the deletion of your data, this purpose persists, you do not object to the processing and, once this purpose has been fulfilled, during the period of limitation of the legal actions that may derive from it.

· Elaboration of exhaustive profiles by the Club: the data provided for the elaboration of exhaustive profiles will be kept as long as you do not request the deletion of your data, this purpose persists, you do not revoke the consent granted or limit the processing and, once this purpose has been fulfilled, during the period of limitation of the legal actions that may derive from the same.

· LaLiga commercial communications: the data provided for commercial communications carried out by LaLiga will be kept as long as you do not request the deletion of your data, this purpose persists, you do not revoke the consent granted or limit the processing and, once this purpose has been fulfilled, during the period of limitation of the legal actions that may derive from the same.

· Preparation of simple profiles by LaLiga: the data provided for the preparation of simple profiles will be kept as long as you do not request the deletion of your data, this purpose persists, you do not object to the processing and, once this purpose has been fulfilled, during the period of limitation of the legal actions that may arise from it.

Elaboration of exhaustive profiles by LaLiga: the data provided for the elaboration of exhaustive profiles will be kept as long as you do not request the deletion of your data, this purpose persists, you do not revoke the consent granted or limit the processing and, once this purpose has been fulfilled, during the period of limitation of the legal actions that may arise from it.

Such personal data will be deleted after the expiry of the time limits indicated.

To which recipients will your personal data be communicated?

Your personal data may be communicated to other persons or companies to be used for their own purposes provided that you give us your consent by ticking the box provided or for the purpose of the service you request. In this regard, we inform you that your personal data will be communicated to third parties as explained in the section "For what purposes do we process your personal data? ".

Specifically:

(i) Club:

Your data will be processed and stored in compliance with the security measures described under current regulations and ensuring at all times its integrity and confidentiality. In general, the Club will not transfer your personal data, except in the following cases: it is necessary for the provision of services, to competent authorities and agencies, administrations, courts, tribunals or any other legitimate third parties in accordance with applicable law, and / or if you have given your express consent.

The Club has the collaboration of some third party service providers who have access to your personal data and who process such data in the name and on behalf of the Club as a result of their provision of services. The Club follows strict criteria for the selection of service providers in order to comply with its data protection obligations and undertakes to sign the corresponding data processing contract with them.

(ii) LaLiga:

LaLiga will communicate the personal data, declared or inferred (identified in the section Where do we get your personal data? ) in the Platform, to the affiliated football clubs that are part of LaLiga Ecosystem in order to allow you access to their assets and have the same profile throughout the ecosystem. All this will be possible as long as you are a registered user of any of the assets under the responsibility of these clubs, in accordance with the privacy policies of the assets of each club and depending on the consents you have granted to them.

The legal basis that legitimizes this communication of personal data is that the processing is necessary for the performance of a contract to which the data subject is a party under the provisions of art. 6.1 b) of the General Data Protection Regulation, in particular, the execution of the services offered to users in LaLiga Ecosystem through the Single Sign-On of LaLiga, which are regulated in the conditions of use of the Platform, and in the conditions of the other assets that are part of the ecosystem. Likewise, LaLiga may provide the user's personal data and any other information when required to do so by the public authorities in the exercise of the functions that are legitimately attributed to them and in accordance with the applicable provisions.

Similarly, some entities subcontracted by LaLiga may have access to personal data and information as processors or sub-processors in order to provide LaLiga with a necessary service, as indicated in each of the purposes in the section "For what purposes do we process your personal data? These service providers sign a contract that obliges them to use your personal information only for the provision of the services set out in this policy.

What are your rights when you provide us with your personal data?

We inform you that, at any time, you may exercise your rights of access, rectification, opposition, deletion, portability, not being subject to automated decisions and limitation of processing before the Club or LaLiga.

What are your rights as a user?

· Right of access: you have the right to obtain confirmation as to whether LaLiga processes your personal data, as well as the right to access your personal data.

· Right of rectification: you may request the modification or rectification of inaccurate personal data.

· Right of erasure: you may request the erasure of your personal data.

· Right to restrict processing: In certain circumstances, you may request that we restrict the processing of your data, in which case it will only be kept for the purpose of pursuing or defending claims.

· Right of opposition: you may oppose the processing of your data for the purpose you specify. LaLiga will cease processing the data, except for compelling legitimate reasons, or the exercise or defence of possible claims.

· Right not to be subject to automated individual decisions: you have the right not to be subject to a decision based solely on automated processing, including profiling, which is likely to produce legal effects concerning you or similarly significantly affect you.

· Right of portability: if permitted, you may exercise the right to the portability of your data, in a structured, commonly used and machine-readable format, and to transmit it to another data controller.

How do I exercise my rights?

(i) Club:

By sending an email to lopd@cdleganes.com.

If you have given your consent for the purposes for which it has been requested, you may revoke it, at any time, by following the procedure established in each of the commercial communications you receive, or through the Subscription Centre found in your profile on the platform and by sending an e-mail to the address: lopd@cdleganes.com.

Withdrawal of consent shall not affect your use of the platform or the lawfulness of processing based on such consent prior to its withdrawal.

Likewise, if you consider that you have not obtained satisfaction in the exercise of your rights, you may contact the Club's data protection officer at the e-mail address delegación.madridnorte@audidat.com or file a complaint with the Spanish Data Protection Agency through its website www.aepd.es

(ii) LaLiga:

If, on accessing and, where applicable, registering on the platform, you have given your consent for the purposes for which you have been requested, you may revoke it at any time, either by following the procedure established in each of the communications you receive, or through the Subscription Centre located in your profile on the platform or by sending an e-mail to the following address: lopd@laliga.es.

The revocation of consents given will not affect your use of the application or the lawfulness of processing based on such consents prior to their withdrawal.

On the other hand, if you have registered on the platform through a social network or similar service, you can exercise your right to the deletion of your data by deactivating the service "LaLiga Ecosystem" within the services connected to your profile on the social network. Finally, if you consider that you have not obtained satisfaction in the exercise of your rights or that the processing of your personal data by LaLiga has not been in accordance with data protection regulations, you can contact LaLiga's Data Protection Delegate by email at dpo@laliga.es or file a complaint with the Spanish Data Protection Agency through its website www.agpd.es.

Are there any limitations?

The Club and LaLiga inform you that users of the platform must be at least 14 years old to register on the platform.
